The UK Parliament – Enterprise and Regulatory Reform Bill 2012-13 includes a provision to clarify that, to be protected against automatically unfair dismissal, whistleblowers must make their disclosure “in the public interest”.

An amendment to the bill was introduced which removed the requirement for a disclosure to be made “in good faith”.  However, where a disclosure is not made in good faith, the employment tribunal will be able to reduce compensation by up to 25%.
